Booking and Accommodation Terms and Conditions
The following Booking Terms (“Terms”) apply to all accommodation reservations
(“Reservations”) made via our website (www.tamodi.com), by email, by telephone, or directly
with Tamodi Estate & Polo Reserve.
Please read these Terms carefully before making a Reservation. You will be asked to accept
them when confirming your booking. If you do not accept these Terms, you will not be able to
complete a Reservation.
1. Contracting with Us
1.1 This website (the “Website”) is operated by Tamodi (Pty) Ltd, a private limited company
registered in South Africa, with its registered office at Tamodi Estate, Plettenberg Bay, Western
Cape, South Africa.
1.2 These Terms are a legal agreement between you (“you” or “the Guest”) and Tamodi Estate
& Polo Reserve (“Tamodi”, “we”, “our”, “us”).
1.3 If you need to contact us about your stay, please email guest@tamodi.com or telephone
+27825565943. If you need to provide us with a formal contractual notice, please see clause 26
below.
1.4 The Website will guide you through the process of making a Reservation. Please ensure
that all details are correct before submitting your booking.
1.5 By making a Reservation you authorise us to charge the payment card provided for all sums
due, including accommodation, additional services, and any incidental charges incurred during
your stay.
1.6 A Reservation constitutes an offer to stay at Tamodi. We may accept or decline your offer at
our discretion. A contract is only formed when we issue written confirmation of your Reservation
by email.
1.7 Tamodi reserves the right, at its sole discretion, not to accept any Reservation. If a
Reservation is declined or cancelled after payment has been received, we will refund the
payment in full.
1.8 We may amend these Terms from time to time without notice. The version published on our
Website at the time of your booking will apply.
2. Definitions
For the purposes of these Terms:
● Guest / Resident: means an individual staying overnight at Tamodi Estate & Polo
Reserve.
● Visitor: means an individual expressly or impliedly invited by a Guest or Resident to the
Estate.
● Paying Person: means the individual, company, or association liable for payment of
charges under the Reservation.
● Duty Manager: means the manager on duty at the Estate at any given time.
● Identity Document: means a valid passport, South African identity card, or driving
licence.
● Estate: means the Tamodi Estate & Polo Reserve, including its lodges, cottages, polo
grounds, equestrian facilities, natural reserve areas, gardens, and trails.
● Services: means accommodation, hospitality, equestrian, or related services provided by
the Estate.
3. Check-In and Check-Out
3.1 Check-in is available from 3:00 PM.
3.2 Check-out is by 11:00 AM.
3.3 Early check-in or late check-out may be offered subject to availability and additional
charges. To guarantee early arrival, we recommend reserving the previous night.
3.4 If you plan to arrive after 6:00 PM, please notify us in advance. Any Reservation not secured
by valid payment details may be released after 6:00 PM.
4. Reservations and Cancellations
4.1 All Reservations must be guaranteed with a valid credit or debit card.
4.2 Cancellations must be made at least 14 days before the scheduled arrival date.
4.3 Cancellations made after this time, non-arrivals, or early departures will be charged at 100%
of the total booking value.
4.4 Group or long-stay bookings may be subject to alternative cancellation policies, which will
be communicated at the time of booking.
4.5 In rare cases, we may need to substitute your reserved accommodation with comparable or
superior accommodation. This shall be deemed satisfactory performance of our obligations. If
the substitute is of lower value, we will refund the difference.
4.6 All rates are inclusive of VAT and local tourism levies where applicable. Prices are subject to
change until confirmed.
5. Registration Requirements
5.1 Upon arrival, all Guests over 16 years of age must complete a registration form and present
a valid Identity Document.
5.2 South African law requires all accommodation providers to record details of guests,
including full name, residential address, nationality, and next destination. These records will be
securely maintained for at least 12 months and may be inspected by authorities.
5.3 Guests under 18 years of age may only be accommodated if accompanied by a parent or
legal guardian.
6. Conduct and Use of the Estate
6.1 Guests and Visitors must respect the tranquillity of the Estate, its wildlife, horses, and
natural surroundings.
6.2 Unlawful, disruptive, or dangerous conduct is strictly prohibited.
6.3 Smoking is permitted only in designated outdoor areas.
6.4 No outside food, alcohol, or catering may be brought onto the Estate without prior written
agreement. Corkage and service fees may apply.
6.5 Firearms, weapons, or fireworks are strictly prohibited.
6.6 Pets are not permitted, except certified service animals approved in advance.
6.7 Guests are responsible for the behaviour of their Visitors at all times.
6A. Behaviour and Conduct Toward Staff
6A.1 All Guests, Residents, and Visitors must treat our staff, contractors, and partners with
courtesy and respect.
6A.2 Tamodi reserves the right to immediately refuse or terminate accommodation, services, or
continued stay where, in our reasonable opinion, a Guest, Resident, or Visitor engages in
abusive, threatening, harassing, discriminatory, or otherwise disrespectful behaviour toward
staff, contractors, or other Guests.
6A.3 In such circumstances, the individual(s) may be required to leave the Estate immediately.
Any payments already made will not be refunded, and any outstanding charges incurred up to
the time of departure shall remain payable.
6A.4 We reserve the right to involve law enforcement where conduct is unlawful or poses a
threat to safety.
7. Equestrian and Polo Facilities
7.1 The Estate includes stables, paddocks and equestrian training areas. Use of these facilities
is strictly subject to prior approval, supervision, and adherence to safety protocols.
7.2 Guests using equestrian facilities do so entirely at their own risk. Riding, polo, and handling
of horses involve inherent risks, and Tamodi accepts no liability for injuries sustained except in
cases of gross negligence.
7.3 Guests must sign an equestrian waiver before participating in any riding or polo-related
activities.
8. Payment
8.1 All accommodation charges must be settled before departure unless otherwise agreed in
writing.
8.2 We accept Visa, Mastercard, and American Express. Cash payments are not accepted. We
do not accept cheques.
8.3 Any additional charges for food, beverages, wellness treatments, polo services, or
incidentals will be added to your room bill and must be paid prior to departure.
8.4 For long stays exceeding seven nights, interim settlement may be required weekly.
9. Liability
9.1 Nothing in these Terms excludes liability for death or personal injury caused by our
negligence.
9.2 Otherwise, our liability is limited to direct losses up to the value of your confirmed
Reservation.
9.3 We are not responsible for:
• Loss or damage to valuables not deposited in the Estate’s reception safe.
• Indirect, consequential, or economic loss.
• Interruptions or limitations to services due to events beyond our reasonable
control.
9.4 Guests are liable for any damage caused to the Estate’s property, furnishings, or facilities,
and will be charged accordingly.
10. Force Majeure
We are not liable for any failure or delay in performing our obligations caused by events beyond
our reasonable control, including extreme weather, natural disasters, pandemics, government
actions, strikes, or utility failures. In such cases, our liability is limited to refunding payments
made for services not delivered.
11. Complaints
Any complaints regarding your stay should be reported immediately to the Duty Manager, who
will seek to resolve the issue promptly. Complaints not raised during your stay must be
submitted in writing to reservations@tamodi.com within 3 working days of departure.
12. Governing Law
These Terms are governed by the laws of the Republic of South Africa. All disputes shall be
subject to the exclusive jurisdiction of the South African courts.
13. General
13.1 These Terms, together with our Privacy Policy, form the entire agreement between you
and Tamodi.
13.2 If any provision of these Terms is found invalid or unenforceable, the remainder shall
remain valid and enforceable.
13.3 Failure by us to enforce any right under these Terms does not constitute a waiver of that
right.
